Jury Verdict Dismisses USA Claims, Finds in Favor of

Menominee Tribal Enterprises’ Employees – Pecore, and Waniger

 

Neopit, Wisconsin – Menominee Tribal Enterprises (MTE) announced today that all final civil claims brought against current employee Marshall Pecore and former employee Conrad Waniger by the United States of America have been dismissed. The suit involving MTE, Pecore and Waniger was filed April 3, 2007 for claims dating back to 2001.

The jury’s unanimous special verdict dismissed all claims against Marshall Pecore and Conrad Waniger in case #07-C-316, United States of America vs. Marshall Pecore and Conrad Waniger. The court entered judgment on the jury’s verdict on November 3, 2009. The jury found that Pecore and Waniger did not violate the False Claims Act with respect to invoices submitted to the Bureau of Indian Affairs for Hazardous Fuel Reduction or in connection with Financial Status Reports for subsidiary funds submitted in 2001 to the Bureau of Indian Affairs.

The judgment comes after a decision and order was issued January 15, 2009 by United States District Judge, Honorable William C. Griesbach in the United States District Court, Eastern District of Wisconsin, Green Bay Division to dismiss all claims against MTE in case #07-C-316, United States of America vs. Menominee Tribal Enterprises. Summary judgment for Pecore and Wanger was denied in the initial judgment.

"We can breath a final sigh of relief now that Marshall Pecore and Conrad Waniger have also found justice and been proven innocent of these charges by the jury’s verdict. As with the previous favorable ruling for MTE in this case, this final civil judgment allows us all to move forward and focus on the stewardship of the sustainable Menominee forest and our business operations for the greater good of the entire Menominee tribe."
